My roommate and I put in applications for an apartment back in February. They said we would be notified by the last week of March or the first week of April is any came open. At the time we applied we saw we were #16 in line for two bedroom apartments. We found out on April 3rd that contracts for the dorms were due on April 4th...in order to keep the room you have. We both decided to sign the contract and pay the processing and installment fee of $140 just in case we wouldn't get the apartment. The afternoon of the 4th I called the apartment complex and the lady told me that there had been 11 openings and the first 11 people on the list had taken them. There was one person iffy but she would have to go through four more sets of applications before she'd get to us. So, this lady and I both figured it was a good idea my roommate and I had signed the dorm housing contract. Then on Friday I got a call from the apartment complex saying an apartment was open if we still wanted it. So, I ran to the office of residential life and told them the situation. The lady claimed that I wouldn't get any money back because the contract clearly stated that the $40 processing fee was non-refundable and that if the contract was broken before July 1, 2000 that it would cost $100....thus, no money back.
This seems ridiculous to me that three days into a contract...one that hasn't even been processed yet (I stopped payment on the check)...that I can't get out of it. Especially considering the situation!
Is there any law out there with a period after signing a contract that you can back out without such a penalty??
