I am advocating for a student at a public University in Oregon and I need legal advice. The student, Mika, is from Korea and is here independent of her University in Seoul. At her University in Seoul, Mika was told that if she wanted to go to school here in Oregon, she must agree to a housing contract for one year.
When Mika came here, she found out that she had the option of applying to be exempt from the housing contract that she already agreed to. She sent an e-mail to housing on Thursday, September 24th requesting exemption.
On Monday, September 28th the director sent Mika an e-mail back saying that Mika's request for exemption was denied because she agreed to the housing contract and said that Mika must wait for an appeal.
Here's where things get interesting.
Housing said that because of the difficulty of arranging a panel to hear an appeal, Mika must wait an indefinite period of time before her appeal. In the meantime, Housing policy states that for every day that first year students (like Mika) are living off campus without exemption and not moved into the dorms, they must pay $25/day that they are not living on campus. The day that the penalty starts is Wednesday, September 23rd.
On Monday September 28th and Wednesday September 30th, we approached housing and housing refused to tell us when the appeal for Mika would be, saying that they already had an appeal planned for all appealing students on Monday the 28th which happened to be after Mika's initial e-mail request for exemption even though housing did not tell Mika about the earlier appeal until after the appeals on the 28th.
Housing finally set a date for Mika and other students appeal this past Friday October, 2nd to be held Friday October 9th at which point Mika's penalty will amount to $550 if they choose to not forgive the fine. Housing is judge and jury in this case, but it seems like there is something fishy going on here.
