I have just been ordered during an Administrative Hearing, to pay a portion of my daughter's medical coverage provided by my Ex-Wife.
BUT!...I already provide coverage for my daughter that is more extensive.
AND! mine is provided by the employer and therefore costs nothing.
AND! My Ex's coverage costs $2730 a year, WHEREAS my stop-loss (maximum out of pocket) is only $2300 a year.
My Ex is doing this to force me to pay more money, even though it actually costs hermore. I have been ordered to pay $201 per month, $95 a month goes to her rediculous medical coverage.
I have offered to cover all uninsured medical expenses which would essentially increase her income by...$231 per month--yet the Administrative Law judge denied this offer.
The judge stated that the rules declare the custodial parent has the right to choose. Although earlier in the hearing, the judge stated that these are just "administrative rules" not laws, and she has the right to overide them.
SO...Do I take this to Circuit Court? Do I spend $1500 on an attorney to fight it...is it worth it?
