Calif. - Pulled over by CHP for tags not yet received from DMV in October. I checked with DMV and they said I should not be stopped during the month of Oct. (since that's when the fees are due) Detained, then arrested for someone else's warrant. Auto impounded. Held for 10 hours proving I am not the person they thought I was (same name) not same description or anything else. Lost full days work. Paid 140. to get my vehicle back and totally stressed out! Where are my rights? Do I have to hire an attorney? How do I go about straightening out this whole mess and get re-imbursed for all the expenses from L.A. County CHP because of their screw-up? I was treated badly and certainly not presummed innocent! Thanks for any help.

Unfortunately, police and CHP have a lot of leeway. BUT that doesn't mean they can abuse their power. Strike while the iron is hot (i.e. lots of police scandal in cali now, especially with rampart district, etc).

Hire a lawyer to get your lost day's work, possible damage to rep, experience of being held for so long, and a possible illegal stop in the first place (not need to stop if DMV tells you shouldn't be stopped).
