we have recently found out that my daughter's apartment manager has been entering her apartment without her knowlege, or permission. the landlord claimes that according to artical 16 of my daughters lease, she has the right to enter any apartment, at any time, without permission from the tennant.
my daughter previously had suspisions that things in her apartment were out of place from time to time, but just shrugged it off, figuring it was her children.
she came home this week and found her bedroom closet sliding doors opened, and she never leaves them open. She called the landlord and was told that they had to perform maintenance, and this so called artical 16, gives them the right to enter any apartment, at any time, without consent of the tennant.
i would like to know where there is something in writing, a law, or statute, that explicitly states that it is against the law, for a landlord to enter an apartment, without the tennants prior approval, except for emergency.

Yes. In California, the landlord is entitled to enter the apartment only under specific conditions, such as emergency, showing the apartment to prospective tenants or purchasers, doing repairs or decorations and a few other reasons.

He should give reasonable notice of his intention to enter, such as 24 hours in advance. In California, the law applies no matter what is in the lease.

However, in order to accuse him of violating the law, you will need evidence, such as a video camera inside the apartment while she is away.

Maybe if your daughter points this out to the landlord, he will pay more attention to his responsibilities.
