What is the name of your state (only U.S. law)? Maryland

Hello,

I am the Treasurer of a very small HOA (13 homes). The neighborhood is only about 5 years old. Our HOA Covenants require an annual assessment to pay for common are maintenance, insurance, etc. For the first time, one of our neighbors has chosen to ignore two assessment notices and is now 2+ months past due. What is the appropriate process we should follow in order to file a lien on this property for their unpaid assessment?

You need to serve the proper notifications on the owner as to the breach (certified/RRR or registered).
You then bring the proof that you did all this to the court with an affidavit asserting your position to the court and if they determine it is probable that it is true, it will order the lien.
You can start to invoke the power-of-sale clause or other foreclosure action after 90 days.

I suggest highly you get a lawyer involved.
