What is the name of your state? Hawaii
Was hired as an officer in a venture capital company located in MD in Sept 2002. In Nov 2002 was sent to Honolulu to establish office and work advance issues with company business. Company failed to get venture capital funding it anticipated and intentionally underpaid wages. Company has now moved to VA, CEO changed out. Old CEO called me in past 6 months and said things were looking promising for company (he is now an officer in Australia with company partnering with stateside portion of company).
Sent letter to current CEO in May 2005. CEO responded in June 2005 that company was not able to financially address the merits of my claim for unpaid wages. Given that company intentionally underpaid wages, what are the legal remedies? What is the statute of limitations? The amount exceeds $10,000.What is the name of your state? HawaiiWhat is the name of your state?

Did you have a contract that specified what your wage was to be? (Not an offer letter, a contract.)

Yes. It was entitled "Key Employee Agreement for XXX" and included terms of employment as an officer in the company, specified Duties, compensation, stock award options, termination. It was signed by the Exec VP/COO and myself and stated "THIS CONTRACT CONTAINS A BINDING ARBITRATION PROVISION WHICH MAY BE ENFORCED BY THE PARTIES. As I read the Arbitration paragraph, disputes to be resolved by final and binding arbitration before the American Aribtrration Association and shall be conducted in Montgomery County Maryland (where company was licensed at time)....this may or may not be problematic for me since I am in Honolulu and I could see this process, as described, taking several weeks to handle.

Since you have an actual contract, only an attorney in your state who has read it in its entirety can answer your question. We cannot interpret the terms of a contract we have not read.
