Unsafe And Dishonest

I went to a dealer, looked at a 97 honda accord. some damage such as hail dents, cracked window, dent in door, damaged ignition, missing key.

dealer promised to fix ignition and key situation. i accepted other damages listed. I asked if there were any mechanical issues with car, was told no, good running car, very reliable. I checked oil and did quick inspection and say no issues, oil was used but looked reasonable. I drove car and noticed no real issues.

took car, 12 hours later went to get oil changed, mechanic showed be completely unsafe issue with BOTH front axcels! neither have a cover 'boot' on them and are wearing rapidly, mechanic suggests that i have car towed wherever im going as they could break and cause loss of control even at low speeds! also notices leaking 'seals' or 'gaskets' where oil is coming out. also, oil is no longer clear, but milky and mechanic says that is from water or air getting into oil through a bad gasket. also says when car is on lot it would set long enough for the oil to look clear.

not to mention the door lock do not work and i could not have tested this before the purchase for lack of key.

what it comes down to is that their were obvious undeclared issues with the car, that i think the dealer was required to tell me about because of the absoluted obvious nature and that they would have been found quickly during a vehicle safety inspection that probably was not done.

any thoughts

My opinion, you should have brought it to the mechanic and had it checked out before you purchased it.

what about disclosure?

is the dealer not obligated to disclose information about obvious flaws? they must have known of the axle damage, are they not required to tell me about this? this could NOT have been missed by the dealer, they are required to do a safety check on each vehicle and axles are on the list(went to another car lot where a friend works, he showed me the obligations list the state requires, such as safety check and time on title work)

$2000-$300

$2000 under "retail/high" book (AKA$800 under real value) and less than $300 in body work including window. If not for the axcel and oilpan gasket, it would have been a 'good' deal
