Your friend is both correct, and wrong - - incredible for someone from Arkansas, but it's true !
No one will hold a gun to your friend's head and force him to write a check to make his CC payments. That part is true. As a matter of fact, they can shout, scream, yell, and threaten all they like and still, your friend can ignore his obligations.
However, the CC company can, and will, sue your friend - - which will cost him big time. He'll be ordered to pay the entire balance, plus interest, plus attorney's fees, plus costs of collection, etc., etc., etc.
Now, I'm not familiar with Arkansas law in terms of how long a judgment will last, or what actions they can take to collect after judgment; e.g., wage garnishments, or bank account attachments, etc. However, one thing is sure - - it won't be pretty.
But, your friend is correct - - no one is going to force him to write a check - - at least for now; unless your friend lives in Oklahoma, and his name is Billie E. Bauer. Then, if that's the case, then your friend is 100% correct, and nothing will happen.
