untrue profanity charge/slander?

state of texas; recent fender bender in which the other person was at fault. person claims that i cursed her out. i only called her a lying bitch with a slip of the tongue. when she accuses me of speeding. no other curse word was said, but she starts screaming out loud that i was cursing her out. my daughter and another child were in my vehicle and they heard us yelling at each other but no other curse words were used and now she is pressing charges on me for using profanity. what are my rights as the other party, and can she press charges for calling her that one name? what can i do if she says that other words were used and it is untrure? this is a small town that i live in and i am a child care provider so i do not want my name being slandered for the one word that was said. it was just a slip of the tongue.which has never happened before. what can i do if charges are brought against me that are not true?[email protected]

My response:

She has absolutely no cause of action against you. You've heard of the First Amendment to the United States Constitution haven't you ?

Sure, go ahead and admit to calling her every name and swear word in the book - - and she can't touch you, or do anything about it. Any criminal or civil complaint against you will be thrown out.

While judges certainly want people to be civil to each other, and don't like it when people swear at each other, or call each other ethnic names, there's absolutely nothing anyone can do. You have your freedom of speech protecting you.

Go ahead, and call her an A S S H O L E for me too!
