I got a month behind on my rent but have since got it paid. Yesterday a sheriff showed up at my door looking for the previous tenants here. They have not lived her in 6 months. Looking at the paper I see it is a notice to appear in court for eviction. I don't know what the problem is but I called the company who I pay rent to and no one is answering the phone since yesterday. So what would happen if they did go to court and get an eviction under a previous tenants name? Would they make me move? Again my rent is paid up and I owe nothing. I would hate to be sitting here one day and the sheriff show up telling me I have to leave. I have even tried contacting the owner of the home with no answer.

My other option is to go to the court house and see if a court date is scheduled then show up there and explain that they served eviction papers on someone who no longer lived at the house. I moved in on September 1st,2014.

So if they were to have a no show from the previous tenant and got possession could they show up and make me leave since I have a lease and they filed with the wrong persons name. I have looked everywhere and have not run across this situation in any of the laws here

Go to the courthouse and confirm that this notice to appear in court isn't for you.

If you don't and it is for you...and you don't show for the hearing and prove that you paid, the request for an eviction might likely be granted by the court and the next step is the actual eviction.

I am going to the court house to make dang sure but all the paperwork the sheriff had was in the previous tenants name. Btw, this is the first I heard about this. No notice or anything was sent to the house before the sheriff showed up. I am thinking they meant to send it to the guy and sent it to the wrong house because I did find out he is renting another house from them. They must have filed and the lawyer put this address instead of his new one. I just don't want them to get an eviction for him then show up here expecting us to leave. Especially since I do not owe anything.
