Hi I had this girlfriend that would wake me up to have sex but she would be asleep but seem awake she would talk climb on top. The first two times it happen she said sometimes she rapes people in there sleep and not to worry third time it happened the next day she wanted to be awake when she has sex the next time it happened I ask her some questions before letting her climb on top of me now she's saying I raped her. In Texas is it rape I tried making sure she was awake

Did either of you report the rape to the police? Did either of you seek medical attention?

She attacked me and I had to call the police to get them to escort me out of the house and she told them that I raped her but didn't file charges and has been sending me texts that I raped her ever since

What happened with the police? No investigation?

I didn't and still don't want her in jail so I didn't file any charges and she didn't that night but she could have later I do know that the cops didn't like her

Okay. So no charges are pending, and you two are no longer together, and you are here wondering what to do about her claims of rape. Who is she making these claims to if not the police? Are they confined to texts to you alone?

She told her family but I don't think anyone else. I don't think she's going to file charges on me but on the other hand I didn't think she'd ever hit me either so I'm just wondering would I be in trouble if she did filed charges

Any time any person is charged with rape, there is cause for that person to be concerned.

Although I think it unlikely that you will be charged given the facts as you describe them, if you are questioned by the police again, or you are charged, you should hire a criminal defense attorney to speak for you and help you defend against the charge.
