We live in California. My stepson has a 1 year old son, who carries his last name on the birth certificate. The mother of the child and my stepson have never been married. They do not live together and my stepson pays child support and keeps his payments current. The mother will not let any of us spend time alone with the child. We can't take him to the park, bring him to our house for the day,or spent any quality time with him alone. But of course "We can always come over and see him anytime we want" but there always seem to be excuses when we try. Our grandson has been with the mother and her parents 24/7 since he was born and my son, his mother and I are just plain being left out. The mother may move to another state at some point in the near future. Can we prevent this?, and even if she stays in the area do we have any legal recourse to the situation described above? You need to go back to court and get a visitation order to guarantee that you will get to see the child. The father must pursue this and unless his character is not morally fit than a judge will more than likely order his visitations to commence. I would ask for every other weekend and alternate holiday visitations to begin with, and un-supervised of course. Also make sure that there is a clause stating that the mother cannot move out of a certain area so that it would impact your relationship. I read alot of CA ?'s on this board and it looks like people get that stipulation put in alot. Good Luck and please consult a lawyer, They are the best authority and consults are always free :D
