I know I mentioned this in threads, but didnt start a thread about it. So incase some of you remember this fraud case, here it goes...
About a week before my wife took off in early November '07 she forged my name on a student loan claiming me as the cosigner, and I of course had no knowledge of any loan along with the documents clearly having a forged signature. Well, early this afternoon she was charged with 4 felonies(i believe the officer said "4"- fraud, forgery- and one other may be grand larceny) and currently in central processing.
We mediated on January 14th(just before filing for divorce same morning) and agreed that I have primary physical custody and her visitation on weekends.
Obviously the situation has changed since the order and want to change her having her visitation on her own to supervised visitation.
Since it's only been a few weeks will this be a struggle to get changed?
Oh by the way in case some of you die-hard "how can you do this to the mother of your child" even think about attacking me..... I AM thinking about our son. She left with no notice and left me with ALL the bills to pay and has NOT PAID a penny in child support. It's hard enough to pay all Im obligated too, including the marital car she has possession of, but simply can not, and will not, pay something I should not.

So... how does Mom's legal "activity" affect your son? Versus not seeing her outside a supervised setting? Really, you've said nothing that differs from any parent not paying support. Why does that warrant supervised visitation? Just curious.

She has been charged yet not convicted. The actions that led to the charges for the felonies are NOT in any way, shape or form a danger to the child (okay I guess if she signed in pencil she could have exposed him to possible lead poisoning if he was there at the time of signing or maybe the ink was a hazard). You knew about these actions that led to these charges BEFORE mediation so NOTHING has changed regarding your knowledge when you agreed to this schedule. Yet now you believe you have the upper hand and want to exploit it for your own reasons that have NOTHING to do with the best interest of your son? And if you now argue it does, that means you wer enot putting his best interests first when you mediated, so therefore I -- and the court -- will call into question your judgment. Give it a rest.

There is so much so i'll try to narrow some of it down.

1) when she took off with him she told no one..not daycare or his special program that he needs 3 days a week(for early development).

2) She took off out of state. In her 3rd address since separation.... not to mention all of her loans in default and no banking acount. She doesnt even give me a strait answer on how she cashes checks from her job.

3) DYFS is still investigating...still has not seen her place to confirm it is suitable for a child.

Thats only 3..and again so much more. And with these charges she is a risk of taking off again with him again, since a lot (if not most) of her associates are not documented in this country and can find a way to "disappear"

And yet you mediated on visitation afterwards correct?

So her finances mean nothing. She does not owe you ANY answer on how she cashes her checks or anything else.

So? If DYFS is investigating and they conclude that there is a substantiated claim then that is one thing. Until then MEDIATION ORDER controls. Got it?

So if that was all at issue why did you agree to anything just a few short weeks ago? Two weeks ago you mediated an agreement and you are telling that all of this happened since then? IF not then I stand by my original assessment that the best interests of your child are NOT your primary concern and you are looking at whatever gives YOU the advantage which brings into question YOUR judgment and ability to be a fit parent as well.

If DYFS cracks down on mom, look for them to also crack down on you for entering into an agreement for visitation as you saw that was advisable. Hence you are guilty of allowing your son to be abused/neglected/dependent just like mom is.

NOPE!
BUT i have a voicemail stating that the caseworker(supervisor) had to go out to an emergency case and could not see her place, and that I had a court order to follow and did not advise me
not to let her take him, unlike a pervious visitation. So There!
What...gonna ban be again Ohio Girl?
Like I said there is so much to this and Im trying to the fullest NOT to put our son in the middle. ASK, dont do whatever attacking ur doing Ms. America
