Well, I posted a message a few days ago about the father of my child maybe trying to pursue visitation after 18months of no contact...all worried about the process and everything that comes w/ it. Anyway, his mother called me today to inform me of the latest...HE'S IN JAIL!!! some serious stuff here and i have a question regarding this. obviously the child support will stop while he's incarcerated, but i need to know how this all owrk in regards to child support. do i need to contact the d.a. or what??

Not familiar with your other posts, but if there's already a court order for CS, then the original order stands. Since the NCP is incarcerated, obviously, he won't be able to meet his CS obligation. But this doesn't mean he's forgiven of it. He will go into "arrears" meaning the debt still accumulates and once he's released, he will be responsible for paying back all the months he didn't pay while in jail.....plus current CS. If the mother gave you a "courtesy call" to inform you of his jail-time as if now his CS obligation will cease - she's wrong! He will just have that much more to pay once he's released.
 
she was trying to get me to get the child support to end, so he won't owe that much when he does eventually get out. that's not my problem and i'm not gonna go out of my way to do anything about it. i'm sure that he can call the office himself or send a letter or something, but i'm not doing a damn thing!!! a while ago when he was over one month behind, the child support office called his emplyer, so i'm sure that's what will happen this time.
 
I AGREE!!! she is that hispanic old school kind of mom where she always stand behind their child, no matter how wrong it is. she can sit there and tell me all of the sob stories involved, but my ONLY concern is my son not hers!!! :p

Some states will allow an incarcerated person to file a motion to suspend support until the jail term ends. Not sure about your state, but if it is one, and he files and it is granted, there will be no arrears building up while he's incarcerated.
 
i'm not sure how the state of CA handles issues like mine, so this is something that I need to fine out. But. it is his responisbility to contact the courts however and handle the situation cause I'll just let the support build & build!!! :D
