Ok, I got a divorce two years ago. the length of the marriage was about 10 years, but we were separated living in different states for over half of it. During the seprataion my ex accumulated a lot of debt, a lot of it medical (under MY insurance) due to "extreme" hobbies, and car wrecks (DUI related). The divorce decree states each of us is responsible for the debt they incurred during the marriage, and says something shady about one party "seeking due release and restitution" from the other party. We did not own a house or credit cards together, so really my only concern was not having to pay those medical bills. Now its turns out she went for bankruptcy. I am concerned the hospitals are gonna come after me after the new harsher bankruptcy laws come into effect. So far, during these past two years only on health care provider has tried to get me to pay them. I'm trying to avoid having to file for bankruptcy, but most of all, i am trying to avoid having to npay for any of her debt.. I cant seems to find any info on this type of situatio, because like I said, we were separated for a long time so the debt is not asset-related like a house or car, and its also not from credit cards or open lines of credit. Does nayone know how to protect one self against this? Is small claims court an option, now that she has obtained a bankruptcy and is therefore no longer legally required to pay her debt back?
