I have an urgent issue because my attorney’s office is closed until Monday morning. I have an exclusive easement on the neighbor’s property for a driveway. It is a concrete driveway that is just a few months old. Prior to the concrete installation the neighbor used our driveway and was unhappy when our permanent driveway was installed because he planned to use it and join his driveway to it (his driveway runs parallel to ours). He exhibited inappropriate behavior threatening our contractor and such and was told by our attorney, the city, and the title company to back off. He did and our driveway was installed, with a height difference of 12 inches at some spots to his driveway. An ongoing negative situation between properties has ensued. He has been cited by the city for numerous code violations, including running an illegal business out of his residence. Derogatory verbal conversations have occurred between him and my husband. The situation just keeps escalating, although we keep following the rules per the attorney and city. We work for a living and today while we were at work (neighbor has his own business and works only a couple hours a week at this point), he marked our driveway indicating the easement area with paint and gouges in the concrete. The police were called when we arrived home. They indicated that he is going to be removing the concrete in the easement area, and that they can't stop him because it is a civil matter. I have a survey, a tax bill that references the easement, a title policy, a csm (recorded legal description of both properties that references the easement), and a recorded easement agreement signed by the previous owner of his property. Is there any way to enforce the protection of my property until my attorney is available Monday morning to file a restraining order? My husband wants to shoot him as he damages the driveway under the personal property protection premise. He isn't feeling resonable at the moment.
