What is the name of your state? California

Hi everyone. Over a year ago child protective service terminated my ex rights because he choose not to do any of the orders the Judge had given him. He (my ex) had 6 months to comply but he choose to continue with his drugs and drinking. So the case was terminated in June. MY question is my signed documents from Childs Superior Court it has down that my ex and I have legal custody.

In a document he's submitting to the court he put down he has join custody.

Whats the diffirence between JOINT AND LEGAL CUSTODY. I mean since Child Protective Service terminated the case and according to the childrens lawayer he has no rights that the girls don't have to see or talk with him until he gets better. Do I still have to consult him when my girls need to see a Doctor, or Dentist or what if my daughter has a accident do I need to consult him to ask if she could have surgery. This is what m ex is saying that I should consult him in everything but he lost his rights in June when he refused to change for the girls.

On our final documents filed in court it shows no visitaion schedule on that Im to monitor the visits when he is not drining and when the girls want to. My daughtes are now 18 and 15.

It doesn't matter what he puts down on his motions with the court, if you can prove by court orders that he is incorrect.

However did they terminate his visitation? If so visitation is vastly different than LEGAL custody. He could still have joint legal custody (where he would have a say so for doctors and education and such and you WOULD have to consult with him) and not have visitation or physical custody of any kind. It would be odd however it is MOST DEFINITELY possible. And from the sounds of your posts his PARENTAL rights WERE NOT terminated. Just visitation was.

It occurred to me that I should add that the 18 year old is no longer effected by any of the court orders. She is a legal adult so its totally up to her whether or not she sees her father. Your 15 year old is the only one who is still subject to court orders.
