Is this ground for Defamation of charicter/Slander

Recently my 15 yr old son recieved an evaluation as he was
sexually abused from ages 5-10, A therapist was brought
into my home (services ordered by his probation officer)
the intent was clearly to treat my son as a victim. Once
her intentions became obvious that she was treating my son
as a sex offender she was escorted to my door and asked
not to return, upon recieving her evaluation report it was
clear she treated and viewed my son as a sex offender even
going as far as falsly accusing him of molesting his step
sister, In her report she accused us also of running from
state to state to avoid treatment for our child, when in
fact we have lived in two states in the past 16 yrs. She
has clearly ruined my son's reputation in the community as
he is a football player in highschool.In her report she
based many assumptions such as he was asked a question if
he were to look in a girls locker room would it excite him
(how many teenage boys would it not?) was my question but
because he stated he would look if the opportunity was
there she translated it in the report that he would likely
rape, and also stated it as an offence which has never
taken place. She has clearly over stepped her boundaries
and as a result the community has stopped other services
recieved from this agency for my son such as (in home
counslor) and (mentor) we was told we accept all services
or non at all. After such slandering remarks from this
therapist who in there right mind would work with her.
Both my son's counslor/mentor has asked to be brought into
court should I get an established case, one in which tells
me he has enough evidence on my case to shut the agency
down, as a mother I can only wonder now. More importantly
the stress this has caused our family defending our son,
not to mention the fact that my son is considering
quitting the football team now afraid he is being viewed
as a sex offender or that the coach will think he is a
molester and bench him. My question is, with this report
in hand do I have a legable case to build on? She clearly
has to be stopped, this is the future of my son and with
this report floating among the community it is very
disturbing and damaging to our family and its all based on
false accusations..

So apparently your son was convicted of a sexual crime, as a probation officer would not involve a therapist for a drug possession charge. That would make him a sex offender.

Absolutely not, I guess I should have expressed myself more clearly, My son was placed on probation nearly 2 years ago for a destruction of private property charge, (He threw burning paper into a dumpster at a apartment complex and it caught in on fire) This is a far cry from being a (sex offender) and has never been in any trouble since.

when we went to court the lawyer brought up my son's past issues as being a (sexually abused VICTIM) in place of a 2 month juvenile stay we opted to have my son treated at a facility in order for him to get the proper help he needed, Those services were never tendered to him through his 10 month stay at this facility.

After talking with the probation officer about my son being sexually abused and the lack of treatment we both felt he recieved from this facility (WE) clearly felt some of his issues was never resolved, So she ordered services from the agency in which his him home counslor and mentor was from since they had a in home sex therapist, It was felt that my son would most likely benefit from inhome services rather then outpatient or hospitilization once again.

NEVER has my son been convicted of a sex crime, If being sexually abused as a child makes him a sex offender, Im sure there will be alot of upset VICTIMS of sex abuse very upset to know they have been labeled as such..
