I would like to use mastheads and subtitles from a number of various magazine covers incorporated with my photos for sale to the general public as novelty products. It is my understanding that the mastheads, subtitles and cover layouts of magazine are copyrighted. So, I have written to approximately a dozen magazines requesting permission to use their cover mastheads for this purpose. I received only one negative reply. I have seen examples of this idea with what appears to be the exact replicas of major magazine covers. Since I received no response from most of my queries, I imagine that this party didn't either. How is it possible for people to use these cover layouts in this manner without, I assume, the publisher's permission, and, specifically, can I do the same without incurring litigation?

The lack of response doesn't indicate acceptance. What happens is usually people violate the law, months or years later the copyright holder finds out and either chooses to nothing about it or sues. So...your choice.
