Use of Neighbor's property

We are thinking of building a pool but we have to go through our Neighbor's property in back of us to get the trucks into our yard. It is just a bare piece of land really. Just wild grass. Someone told me there is a law called EASEMENT OF NECESSITY that in this case it is ok for us to use it??? Our previous neighbor who had the reputation of being an absolute difficult person to deal with would not let us because of some ridiculous reasons. We have new neighbors now. But I just want to know if the law if on our side and how to proceed??

Not without permission.

Then ask nicely.

Thanks for the reply. Should we get something in writing in case in the middle of the project they may change their mind?? We can't take that chance...(if they said yes at the beginning). Can we just write something up ourselves??
