I live in the state of Georgia. I was in a car accident where it was not my fault and found out my car is totaled. Does the insurance company have to pay for a rental car for me? If not, do I sue them to pay for the rental car. I need to add, that my insurance company is the same insurance of the person who hit me. My understanding is the State of Georgia law says they do not have to pay for a rental car. I would think that the inconvenience of not having a car that they would at least pay for the rental car until they give me the settlement check so I can buy a new car.
