used car died 1 week after purchase

What is the name of your state? north carolina
We bought a 93 ford bronco one week ago for our daughter. I had the front end inspected by local tire company..they said it was fine, i had the oil changed by jiffy lube, got the car registered on wednesday and sunday it died. This was a private sale. Do we have any recourse?

When you say the vehicle "died" what specifically occured? Did the engine stop running, will it run but not move? Please give us more information so that we may help you. Thanks

My response:

From a legal standpoint, it is of no moment why the vehicle fails to run, and has "died." It could be out of gas - - who cares? The fact is, it's "dead" and the reason is irrelevant.

The only thing that matters is whether or not you received any warranty concerning usability as part of your "bargain."

In a private sale, and without a written warranty, your sale is controlled by the legal maxim of "Caveat Emptor" - - "Let the buyer beware." In a nutshell, and if the seller and you failed to agree on a warranty, you have no legal recourse. The vehicle is yours "with all faults."

The fact is IAAL, they had the oil changed by Jiffy Lube and maybe Jiffy Lube forgot to tighten the oil drain plug - that is why I wanted to know what their definition of "died" is. So happyappys, unless you have something written from the seller in the form of a warranty, you are SOL I am afraid - unless Jiffy Lube can be held responsible, which is probably not the case. The other question I have is regarding the front end inspection by a local tire company - what does this have to with anything? You could've taken the vehicle to most qualified shop in the universe and had the best mechanic inspect it - some failures are internal and cannot be detected by inspections, some failures occur with parts that are not inspected. I am sorry this happened to you, but I think you are out of luck here.

So what if he had the car serviced by Jiffy Lube? So what if our writer had Cheerios for breakfast? What does THAT have to do with the issue?

The clear import of our writer's post was telling us - -

1. The car died, and

2. That it was a private sale; and

3. What could he do about it.

The "ISSUE" was whether our writer had any rights against the seller of the vehicle - - not Jiffy Lube. I think that if there was a problem with Jiffy Lube, and if there was an oil leak, I think our writer would have been smart enough to - -

1. Tell us he had a problem with Jiffy Lube, and

2. Tell us there was a puddle of oil under the parked vehicle.

But, he didn't. And, that's because our writer's "intent" of the post was to find out if there were some "rights" he had as against the seller.

It really is a pain in the butt to discuss legal concepts with someone who has no legal training, only to discover that people like yourself are not trained to "hone in" on the legal issues.

You come up with all sorts of "what if" scenarios that are just not there. What if the Sun fails to come up in the morning? What if the sky starts falling? What if, what if, what if?

Just stick to what the writer says, and hone in on the legal issues and theories. That way, you won't have to guess and ask 20 questions of the writers.

You give objective opinions and you are correct in saying that I know very little of legal concepts - that is why I initially came to this site. I can not hold your opinions against you. My objective was not to raise 20 "what if" questions, rather I wanted to help the poster to the best of my ability - which as you put it, less than existant. And it really is a pain in the butt to discuss automotive concepts with someone who has no automotive training - if Jiffy Lube forgot to put all the oil in the engine or tighten the oil drain plug, my guess is this customer would notice ZERO oil under the parked vehicle because:
A.) THE DRAIN PLUG MAY HAVE FALLEN OUT WHILE HE WAS DRIVING DOWN THE ROAD
B.) AN INADEQUATE AMOUNT OF LUBRICATION MAY SUSTAIN AND ENGINE FOR A SHORT PERIOD OF TIME

Thank you for your opinions - I guess I'll keep mine to myself from now on as I don't enjoy reading sarcastic replies from other posters. I wonder how many people your gruff manner scares away from this site.

You, again, have failed or refused to grasp the legal concepts. This is NOT an automotive site - - it is a "legal" site. You don't NEED to discuss automotive concepts on this site because such concepts have nothing to do with law.

You failed to understand what I said in my previous post, with my numbered topics, and there's no use in trying to explain further. You don't understand law, and that's the only fact you and I can come away with from this thread.

You want to be pissed? Who cares.

Well if it's just you, then that leaves about 270 million, minus one, to go. You see, when you're in a sea of human beings in this country, the one person, or even a thousand persons, don't matter.
