What is the name of your state?

NJ. My daughter purchased a used car based on the info received from the seller. She was told that the car was owned by his family. She paid him the asking price of $1650; had it checked out by her mechanic; and found that it needed a new axle that would cost $400. She made a phone call to the seller and told him about the needed repair and asked if he had any knowledge of it. The seller denied knowing about it and told her to check around to get a cheaper price for the repair. When she bought the car, she told him she would be traveling back and forth to college and needed a reliable car and would have to sell the car she purchased. He said he had no problem with the car and that it was running great. A little investigation revealed that the seller bought the car from a car dealership one month prior for $500. She would like return the car to him and get her money back. She feels that she was lied to, deceived and taken advantage of. Does she have any remedies?

She doesn't have very many options, and none that will be what she is wanting. It's her responsibility to have it checked out prior to purchasing it. If the seller did not give her any kind of guarantee/warranty, which I am sure he didn't then she has no recourse. She can always try to go to small claims court but it would probably be a waste of time as she has nothing on her side.
