What is the name of your state? Texas
we are buying a car from a used car lot, and we are having lots of trouble with it. we have had the car for less than 90 days, and it alreadly has broke down twice. it also need a new transmission. we have already paid almost 5000.00 dollars of the 10,000.00
he wants for it. at this point we feel that spending any more money on the heap it not a sensible decision. is there anything
we can do if he refuses to fix the car. can we get our money back or possibly get a different car?help!!!!!!!!!!!!

Do you have a warranty or did you buy the car "as-is"? Did you have the car inspected by an independant mechanic before you bought it? What year is it and how many miles are on it?

Texas "Lemon Law" does not apply to used vehicles.

*** What do you mean 'buying'?? Either you purchased it or not. Do you mean that you bought it and are making payments to the dealer???

*** And what, if any, warranty did you get from the dealer when you purchased the vehicle?? Was your sale noted "AS IS"??

*** Here we go again. Your post says that "he wants for it" implying that the $10k is his asking price.... and that you haven't purchased the vehicle. So, what is it.... is this YOUR vehicle or HIS vehicle that you are paying to repair??

*** Confusing!!! Your post says you have already paid $5k in repairs. What do you now mean about his refusing to "fix the car"???

*** Based on your post, you appear to have no specific rights for a refund or replacement. However, depending on specifics, you MAY have a claim against the seller for 'deceptive trade'. I would suggest you consider paying the next $100 to an attorney to review your situation and see if there is any recourse.
