using my last name

My girlfriend and I are expecting a child next spring, and will not be getting married before it is born due to time issues. We both want the baby to have my last name, but are unclear as to the legalities of it. We have both been told differing views. Can the baby have my last name when it is born? Thanks.

If you live in IN, MI, or OH then the answer is yes. if you live in one of the other 47 states then I don't know.
