What is the name of your state? AL

I'm making a website and software application, that will use images of various music-related products, such as guitar amps, effects units, etc. The website/software application will only explain how to use these products, for example, it will explain what settings to use, what order to hook them up in, etc.

Instead of manually drawing images of the actual products, I will be using real photos. I plan on using the images from http://www.MusiciansFriend.com. Here is an example image: http://img3.musiciansfriend.com/dbase/pics/products/2/1/7/239217.jpg

Do I need to ask permission to use these images, even if I put some kind of a disclaimer, or state something like 'Images provided by MusiciansFriend.com'? Or, 'All registered trademarks are property of their respectful owner..." or whatever it is...

Also, I will be re-scaling the images to a smaller size, does this change anything?

Thanks! :)

So, you want protection for YOUR work but you don't give a rip about someone else's work?

Uh, I'm not trying to rip off anyone's work...

I was just asking in general, if it's okay to use those photos as long as credit is given, and/or a disclaimer is posted.

I already asked MusiciansFriend for permission, but I have a feeling they will tell me to ask the actual manufacturer's of the products (who provided the images to them). I really don't want to have to ask every different manufacturer, for each individual image if I don't have to. That would take forever.

Anyway, thanks for the contribution.

Danny

Yes, you must have permission. Having a disclaimer MAY mean the owners will not sue you right away and allow you time to cease and desist, but they do not have to.

No. You must have permission to legally use the pictures. A disclaimer will provide absolutely no protection whatsoever.
