Hi guys, I currently have a video hosting website and would like to add a Terms of Service and Digital Millennium Copyright Act page, to further protect me in case users decide to upload illegal videos (copyrighted movies for example).

By participating with the DMCA, they usually give the server about 24 hours to take down the video, and I am willing to abide by their rules.

My question was, there are several other sites exactly like mine, which all have their own pages for these; can I copy the information that is on that page, replace their site name with mine, and upload it to mine? It seems like very general terms.

You want to steal the DCMA notice in order to prevent people from uploading stolen stuff? Have I got that right? :rolleyes:

Yes I want to copy it, I'm pretty sure it makes more sense to do that IF it is allowed as opposed to spending money towards getting it written out.

Yes I do HOWEVER the reason I am posting this thread is because I am unaware of if you are able to do it or not, maybe you can, I do not see the harm in asking this question. I am seeking HELP, so a straight forward answer is all I need, not a snarky remark about what my attempts are. I consider reading these replies to be useless, at the end of the day I'm still at square one.

You state that you wish to avoid having stolen stuff on your website and you wish to post a notice advising people on how to have stolen stuff removed.

You want to steal that notice from somewhere else.

If you can't figure out the answer, then I would suggest that you turn off any computer, cell phone, or any other electronic device and go find yourself some other pursuit.

axax, you can pattern your own terms of service and your own information on the DMCA after what you run across online on other sites.

But, as Zigner said, you cannot (generally) use another's copyrighted material without permission from the copyright holder. You can pull only from this copyrighted material the facts (which are not copyrightable) and then create your own writings from these facts.

Otherwise you will be violating your own terms of service and receiving your own DMCA takedown notice to remove from your site the terms of service and DMCA information that you infringed (hence Zigner's response to the irony of your question).
