i recently purchased a lot to build a home on in california.

both the buying and selling agents advertised in writting that the utilities and road would be installed by the seller prior to the "building season 2001"; the lot is located at 7500 ft. elevation and was covered with snow at the close of escrow. Only recently has the Engineering company contracted to due the construction even applied to the federal government for the required permits. needless to say i cannot even start to build until all the utilities and access road is installed and at this point do not think that i could start building until atleast 2002.

What are my options ?

Does your purchase contract state those same issues?
If so, you can sue for specifc performance and breach of contract.

I briefly reviewed the purchase aggrement and did not see a direct reference. I will review them in more detail this evening. The only reference I have found is the marketing material provided to me by both the listing and selling agencies.
This lot is part of a new subdivision , and the plans were all reviewed and approved by the Sate of Calif. dept. of reality.
There is also a arbitration clause though specified in the purchase aggrement.

If there is no language to that effect in the contract, you may be waiting a long time.
There is no State Dept of Reality in CA unless you consider the one in Disneyland.

The Department of Real Estate of the State of California does exist.
They issued the Fianl Suvdisision Public Report on August 31, 2000.

You wrote State Dept. of Reality. It should be Dept of Realty. Is it real or is it Memorex?
