I am wanting to purchase a piece of property within city limits (in CO). There are above ground and underground utility lines that run through the middle of the property (not along the property lines) that have to be moved before we can build. A title search shows no utility easements. The utility company says that since the lines have been there since the 50's, they are grandfathered in, even though they did not purchase a utility easement. How can this be? We will have to pay to move the lines ($8000) unless we can prove they were put there illegally in the first place, or are there illegally now. Any suggestions?
