I am from Illinois. I recently brought a house that has been in my family since 1940. Their was a street that ran through the middle of the street that was vacated by the city in 1907. The end of the street runs directly behind my house so I know that I am entitled to at least half of the width of the street, but the assessors office at the court house put the entire width of the street onto my real estate taxes. So basically we have been paying taxes on too much property. But my question is do I have any rights to the second half of that street since we have been paying taxes on it and have been doing the upkeep. No one else lives behind me so really no one else has rights to it the second half, because the city stills owns another street back there that would have made a right angle to the vacated one. If anything, the second half would have been added to the other city street that runs inside the block and directly behind my house. But can the city take back what they already vacated. Basically, the part in question is in limbo because the city records do not show anywhere where anyone owns it including themselves. However the assessors office says that it belongs to me and any record that I can find showing the part in question has drawn the amount in question therefore adding it to my plat. What should I do.

I have already talked to a surveyor, but they can't not tell me legally what is or what isn't my property. The extra footage has never been added to my deed, that is where I am running into trouble, because I don't know what legal rights I have to that property since my family has been paying the property taxes on it and maintaining the property for over 60 years. I was hoping that maybe you or someone else would be able to give me some insight into this situation. Any help would be greatly helpful. Thanks.

Read my post. I said to get a survey as in hire a surveyor and pay to have a survey map completed.
You already know that taking to a surveyor will get you nowhere.
