Vacation Pay After Termination/Resignation

What is the name of your state? New Hampshire

if an employee resigns with their 2 week notice requirement being met, then he does not come in to work for 2-3 day in a row - leaving us to believe that he will not be returning, then we say on the day he decides he wants to come in that his services are no longer needed (terminating Him), are we required to pay him any vacation pay that is given at the beginning of the fiscal year, that he has not taken?

New Hampshire does not require the payout of vacation upon termination. It only requires the employer comply with their policy they have a policy or practice of paying out vacation to a departing employee. If, for example, your policy says you will not pay out vacation to an employee who does not work all of their two-week notice period, then you don't have to pay it.
