We recently purchased, not a timeshare, but 15 weeks of vacations from one of the time share companies who made a presentation to us in Cancun, Mexico. What I mean by this is, we signed up and paid for membership via credit card and we get 15 weeks of vacations to be used up for 15 years. It is a package where we pay $387 for one week of using a resort condo anywhere in the world.

What we would like to know is since we paid by credit card and we signed the contract in Cancun, Mexico, can we still void this contract?. The contract does not state anything about cancellation. We do not want it since it is costly for us at the moment.

We would appreciate your help.

What does the contract say about cancellation? Is there a procedure to cancel? A buy-out fee? You'll need to take the contract to a lawyer. Without seeing the contract, we can't even tell if US or Mexican law applies.

This is not legal advice and you are not my client. Double check everything with your own attorney and your state's laws.

Consumer protection laws would dictate cancellation requirements in the contract provided the company is a US entity. You can dispute the charge with the credit card company as long as the company/bank is a major national credit card issuer such as Visa, MC, AX etc. It does not matter if the transaction took place in Mexico outside of the US.

Nothing on the contract states anything about cancellation. The contract stated that the Mexican Law applies on it.

Thanks for your help.
