I am a contractor and my employer is dipping into our accrued vacation time and PTO (that we purchase on our own, they do not) to use to make out a normal '40' hrs of time. For example, if I normally work 40 hrs a week and I decide to take a day off and I do not want to use my time for it to make 40 hrs and rather take the loss and get paid for 32 hrs, and save what time I accrue to take a vacation, I should be able to. The employer is depleting the time to make 40 hrs, regardless of what we want to do with our time.
Is the company allowed to do this?What is the name of your state?

Yes, the company is allowed to do that. In fact, in some circumstances, it's not impossible that they are required by law to do that.

There is a formula, with what the h & w is and your hrly wage then 40 hrs, roughly mine is about $36 bi weekly and it's not like I get the whole 5 days a year in a lump, it's accrued at almost 45 minutes a week. So for what I'm paying into sick time, they can take and use it how they want to. The Vacation time they pay for and accrue.
