Colorado: About five years into our marriage, my husband and I found that my first marriage had never been voided (the divorce was never finalized, which I was unaware of.) At that time, my Attorney went ahead and did the divorce proceedings for that first marriage, stating that my current marriage was null and void -- and that we would need to get married all over again. We did not. We did continue to live together - now this 10+ relationship is breaking up, and I am confused as to whether we need an actual divorce, if this is a common law marriage, etc.??? We have three children, and there will be child support to deal with... otherwise division of personal property is not a problem.
What is the best way to deal with this situation?

A common-law marriage may be established by proving cohabitation and a reputation of being married.
