Validity of a Contract

Can an individual contract to lease a residential apartment
(to a student) if the individual does not yet own the building when the lease agreement is executed?

I dont see what the problem is other then if the building is not bought and he doesnt refund your money, OR if he tries and collects "rent" on something he doesnot own yet...then it becomes a criminal fraud procescution, and the asssssshole can go to jail...

Maybe he just want to know he can start collecting rent, as soon as he closes on the building....
