Validity of marriage.

In Alabama, you must be divorced 60 days before you remarry.

If a resident of Alabama gets divorced, goes out of state and marries someone else when the ink is hardly dry on the decree, and comes back to reside back in Alabama, is the marriage valid?

yes you are married,you could not grt married in alabama but you can get married in any other stat that alowes you to.you may want to look into it more but i beleave this is right.

Thank you for your time, but speculation isn't what I'm after.

I'd like a lawyer or someone who has experience in a similar matter to respond.

See section 30-2-10, you cannot get married unless it is to each other within that 60 time frame. This is true for someone in ALabama or any other state. Other states will give full faith and credit to AL's laws.

Thank you Mary Ray. Does this also apply to a marriage outside of the United States? From South of the Border perhaps?

In such a matter, a Visa has been issued to an individual who went through (what I believe to be) a fraudulent marriage. She is able to work and live in the US.

I called INS, and they said it was a state matter. If a Visa was issued under fraudulent circumstances, I don't understand why it wouldn't be in INS' interest to check it out.

Any thoughts are appreciated,
