I had a 97 Dodge Neon stolen in NJ. Its blue book value is $5500. A man who had outstanding arrest warrants was in a hit and run accident on the turnpike and ran through the woods from the police and stole my car. The next day he called police to claim his car was stolen (so he could cover himself for the hit and run). Later he drove my car back to N. Jersey to where he lives and set it on fire to hide evidence. I didn't have theft on the insurance policy but I would like to get my money back from the criminal. How would I go about doing this? If the state convicts him on stealing my car and torching it, will the state order him to reimburse me for the value of my car? Or do I have to have a seperate trial whereby I sue him to get the money from him? Also, can I sue for more than the value of the car? This has really affected my life in a negative way and I want to try and get this guy if I can. Thanks.
