Virginia; My brother lent a friend the credit line on his credit card as a favor when his friend was in a bind. The friend agreed to pay the amount in full and was sending payments directly to the credit card company for over a year. My brother recently discovered, while applying for a loan, that the account his friend was to be paying on was six months past due. He has been unable to contact the friend and has assumed this debt as he is the primary cardholder. Would my brother stand a chance in court if he has proof that the friend was paying the account for over a year, thus binding the verbal agreement which they made?

My response:

Yes, as long as your brother knows the bank where his friend has his checking account. That way, your brother can subpoena the checks the friend used to pay the credit card.
