Are there any laws/info on verbal agreements? I live in CA and want to take someone to small claims for 200.00. I'm totally poor however even though I need the money, it's more for the principal as I really went out of my way for this person and got stuck in the back.
The person agreed to pay a monthly fee to a music rehearsal space, and was made aware of the amounts of money in writing in front of witnesses. At the time she did not have a job, and I told her in front of people we would not get the space if she could not contribute. She had a few weeks to find a job. Then we got the space, she kept saying she'd pay the money when she found a job-after two months we cut her off from using the rehearsal space for not paying. She hardly looked for a job; total I think was 2 1/2 months and she went on 3 interviews. Sat on her butt-lazy. She verbally committed to her portion of the rent, and although her signature is not on the contract her name is listed as one of the tenants, and she verbally committed in front of several other people. She also stored equipment in the space in addition to using it for rehearsal.
I know there's something about "verbal contract" or "verbal agreement." What's the best thing to do? I want to write her a 30-day warning letter first about taking her to court, and refer to the law in my letter.
