Verbal contract
In May 2000 my brother in law in exchange for a hot tub was to put a privacy fence around our yard. We gave him the hot tub, and he got the supplies. When it came time to put up the fence he couldn't get any labor so we had to provide it. As of today he now wants reimbursed $1100 for the supplies and says he will sue us. We told him we would not pay him for the following reasons 1. we provided the labor (all he did was nail the boards) 2. the fence has still not been completed 3. he receive the hot tub, 4. he has never sent us a bill and 5. he and his wife owe us $750. He says the hot tub was not in exchange for the fence we (& witness) say it is. Can he sue us w/out ever producing a bill, and not completeing the job since it has been 9 1/2 months. We live in Kansas
