texas. brother-in-law took me last year for over $10,000.00 on jobs i did for him. this year he came to me saying he could pay some of it back by turning a friend of his who needed a new roof over to me. his words " you do the estimate, i'll go the first time and tell him your company will handle it all, he signs with you and you handle all money. 50% will go towards my dept to you". I accepted, did all the work, called all the subs (gutters, carpenters etc..) talk with customer couple of times, took colors to them, helped get more money from insurance they owed them,and when I faxed estimate ( my letter head) to brother-in-law so he could fax it to customer ( which he did fax to customer). Then he went over without me and had him sign with company he works for ( says he is partners in ). this is a $15,000.00 roof replacement,with approx. four thousand dollars in profit. he used me and lied to me the whole time, and the customer knows my envolvement. can i sue, while putting intent to lein on customers house in case they don't pay. I have invoiced for profit since that was a part of the deal, i take all the profit, he gets nothing.
