Verbal Contract

Guest
I am from Idaho and a Publishing company in Florida contacted me by phone to sell magazines. I was under the impression this was a 24 week agreement that could be cancelled. I received the bill in the mail and it is a 24 month agreement with no option to cancel! I have contacted them to terminate the order, do I have any legal standing?

If the person on the phone mislead you to that it was that person’s fault that you believed it was a 24 week agreement that could be cancelled, then you have a legal right to cancel the contract. However, if the misunderstanding was your fault and there was no misrepresentation, then you are legally bound to the contract.

The problem here, as with all oral agreements, is to prove your case. The best strategy is to approach them with a positive statement that they mislead you and you are canceling.
