What is the name of your state? VT. I received my last paycheck in july of 05. I received a letter that I should of not been paid for my last two weeks, since I was out sick. Understandable. Yet, because of my lawsuit against the company my attorney advised me not to pay it back due to illegal termination. So I didn't. They put the check amount into collections, and now onto my credit report. Here is where the confusing part comes in. I received my w-2's the end of january 2006 and my husband did our taxes. Just last week April 3, I received another w-2 from the company. It was a correction w-2. It was the amount they paid me from july of 05. Why wasnt that in the first w-2? Plus that amount is in collections as well. Our taxes are already done. Is this ok for them to do? Faith

Was it a form W-2C? That is the proper way to correct a previously issued W-2.

The fact that you did not cash the check does not mean you did not constructively receive the wages and therefore it is correct that your W-2 include such wages.

Im trying to figure out where it said I didnt cash the check. I did cash the check back in july of 2005. My last paycheck. It was 30 days later I received a letter claiming that check should not of been issued and they took out taxes and child support due. They then put the amount of my last check onto my credit report. I received my normal w-2's in january of this year. Taxes were sent out. Last week I received a W-2C which shows the amount paid to me from my last check. How is it they took taxes out and such back in 2005, but never added this amount into my yearly amount earned? Something just doesnt seem right.
