hello,

i was in one of those mail order book clubs a few years ago. i sent one book back because i already had the title, but they claimed they never got and kept sending the bill. i refused to pay, so now it's in collection. they all pretty much say the same thing, except for this new one.... they claim that my name has been reported to the "consumer credit index". is there such a thing?....i've never heard of it before.


they've also implied a lawsuit if i don't pay, but having a hard time believing they'd sue over $36. i know the maximum to sue in small claims is $3000, but is there a minimum?

No minimum for small claims. Of course if it goes that far it will cost you more than twice the $36. Since they are the plaintiff, they would be required to show proof that they sent it. And if you dont have proof that you didnt send it, plan on paying up. Now whether they would waste the time and money going after $36, i doubt that.
