victim of other persons insurance

My garage door was hit and damages came to 1900.00 (door,opener,board-up and 2 personal items inside) I get all estimates,receipts and now his insurance only wants to give under1500.00. My agent says take it and don't make claim under my policy because I will be out my 1000.00 deductible. A couple of lawyers told me to file claim. Who is right will I be hurt because of what someone else did to me? I have already paid for everything out of pocket because I had already gone without a door and vehicle stuck in garage for 3 weeks. They just continually change their story. The person that hit my door was a scavenger picking up an old fridge and has no money I'm sure. Although he did have auto insurance not that that makes a difference. Thank you for any truthful information.

You're not a victim of their insurance. Their insurance company is not responsible for your damages. They are. If you don't like the offer, sue the homeowner in court. The insurance company will pay whatever the judge orders them to.

That would probably be the only way to increase the amount of $$$ the other insurance is offering you. I wouldn't file a claim with my own insurance because you do have to pay the deductible and there's no guarantee you will get it back. Also, you may lose the Claims-free discount which could cost you $hundreds for the next 3 years.

Are you trying to get the money or a NEW door? Or, are you trying to recover the value of the OLD door (etc) that was hit?
