Yes. I am the complaining witness in this case. And I have filed a report with the police which is now in the investigation stages. Our police department is really good about not being aware of the laws governing victim's rights in our state and have at one point told me, when I questioned them about the required notifications, that it's not department policy.

I am not a California attorney.

But it sounds like that NOW (after you have filed the complaint) that they can ask you for a polygraph (which, in my never to be humble opinion) is worthless.

See, and this is where it gets confusing. Because the initial incident report is entirely different than an accusatory pleading, and the police report does not get presented to the court; it can be attached to the arrest warrent, but again, even the arrest warrant is not the same thing as an accusatory pleading.

I'm waiting for a call back from our local DA's office to see if they can better define it, but not sure they will be of any help.
