Will you please tell me if this is a violation of HIPAA?
I do not know what forum to post this in. This is the most appropriate forum I could find.
My son has been in therapy for 2 years and is on meds for a mood disorder. He goes to therapy 2 times a month. I have been the only one who has taken him to therapy. I have primary physical custody, his father has visitation. Because of many concerns from both his therapist and I regarding my son's father, my attorney filed a motion in court. We requested that the father attend therapy with our son. The therapist wants to see the 2 of them interact, amongst other things. His father is rarely in our son's life. He goes months without seeing him. Our son has told his therapist on several occasions that he's afraid of his father, and there are other issues.
I was diagnosed Bipolar 2 years ago. However, the diagnosis is questionable. I am off all meds and have been for 9 months. My psychiatrist knows I'm off all meds and he believes I am doing good without them.
My son's therapist knows that I have Bipolar. I specifically told him that I do not want this information shared with anyone.
My son's father went to his first appt. with my son's therapist last week, which his attorney told him to attend. Well, I just found out today that my son's therapist told my son's dad that I have Bipolar. Child Protective Services are investigating the father, and the case worker told me that the father told her (case worker) that the therapist told him I was Bipolar. I specifically told this therapist not to discuss my mental health with anyone.
He's not my therapist. But he still has to file HIPAA laws, correct? He is a pschologist.
