Greetings,

I live in the state of Florida and am currently on a reinstated double probation (county and state) for "leaving an accident w/ bodily injury" in Oct. 2000 and violating my initial probation in April of 2001 w/ a DUI.

Yesterday I went to my monthly visit with my state probation officer and tested positive for THC in my system. I was not arrested and was told that I need to go back and see her tomorrow for a follow up. I don't buy drugs, didn't have any paraphanelia or drugs on me either. What, if anything, is done to those who test positive for drugs during probation???? I am afraid that she just gave me one more day of freedom and will have a warrant out for my arrest before I can consult a lawyer tomorrow.

Does anyone have any idea of the kind of punishment that will take place?

any of three things can happen. your probation officer can violate you and send you right back to jail. or return you to the court where the judge will decide your fate, or a step up proceedure where you have to report for testing at a moments notice any day. you should have recieved a "terms of probation" copy when you first signed up for probation, the paper discusses terms of probation and whatever penalties attatched to the violation of those terms.read it
