What is the name of your state (only U.S. law)? Virginia

Is there an appeals process for regulation(s) that get passed by state regulatory authorities regardless of negative public comment? Can a person whose professional certification, who is affected by the regulation and does not support the new regulation, form the appeal?

The answer is NOT any different now then the last time asked.
You do not have any specific rights. Just because there were exclusively negative comments at a public hearing doesn't mean the regulatory changes were not valid. Your avenues to challenge the regulation depend on just WHAT YOU ARE TALKING ABOUT, and if you don't tell us like we asked the first time you brought this up, we are not going to be able to tell you anything further. There are substantial differences depending on whether we are talking healthcare or one of the other regulated professions.

Flying Ron - thanks for both replies. I was initially unable to see the first post - that is why it was resent. The affected professions are soil scientists, professional engineers, onsite soil evaluators**************thanks

What is the status of the regulation you are objecting to? Has it been to through the Governor or the Legistlative review? You can try heading it off there. Otherwise you'll have to trundle off to Richmond and file your challenge with the Henrico circuit court there.

Thanks again. I did send both letters and emails to my State Senator, State Delegate, President of Virginia Assoc of Prof Soil Scientists, Exec Dir of VA Society of Prof Engineers, Exec Dir of DPOR, and the Exec Dir of the APELSCIDA Board of DPOR. Also, attendance at the public hearing on the legislation. Legislation creates a new regulatory board within DPOR and is under review and public comment through early March. I just wanted to find out what I could about possible next steps should they be needed. Thanks,
